SILVER HAIRED LEGISLATURE RESOLUTION NO. 4006
A RESOLUTION urging the Legislature of the State of Kansas to support the request of Area Agencies
on Aging to exempt purchases by all Area Agencies on Aging from sales tax.
WHEREAS, Purchases by three of the eleven Area Agencies on Aging are currently exempt
from sales tax because those agencies are administered by county governments; and
WHEREAS, The other eight Area Agencies on Aging are not exempt from sales tax on products
and services they purchase to provide services to their clients; and
WHEREAS, Because of this disparity, thousands of dollars that could be used to provide
additional services to senior clients must instead be paid by many Area Agencies on Aging to the state
in the form of sales taxes; and
WHEREAS, Area Agencies on Aging paying sales tax are non-profit organizations exempt from
federal income taxation pursuant to section 501(c)(3) of the federal internal revenue code; and
WHEREAS, Area Agencies on Aging request sales tax equity among the agencies through a
sales tax exemption for all Area Agencies on Aging in Kansas: Now, therefore,
Be it resolved by the Silver Haired Legislature of the State of Kansas: That we urge the
Legislature of the State of Kansas to support the request of Area Agencies on Aging to exempt
purchases by all Area Agencies on Aging from sales tax.
